An Alna man is facing a felony aggravated assault charge after he allegedly pushed a female relative repeatedly and choked her twice during an argument in Jefferson Dec. 5, according to court documents.
Kysten Wallace, 28, was arrested after Lincoln County Sheriff’s Deputy Justin Drake responded to the report of an assault at an address on Hemlock Drive.
According to an affidavit by Drake, the woman alleged Wallace repeatedly pushed her, she struck him in self-defense, and Wallace then choked her.
“She said she couldn’t [breathe] during the assault,” Drake wrote.
Drake observed a small amount of blood on the woman’s face and “what appeared to be scratches or red marks on her neck area,” he wrote.
“Mr. Wallace had blood on his face and appeared to have a bloody nose,” Drake wrote.
Both the woman and Wallace admitted to arguing, but Wallace alleged the woman punched him seven times and he only touched her when he pushed her away.
“Based on the totality of the circumstances, I believed that Mr. Wallace was the predominant aggressor,” Drake wrote.
Wallace was charged with aggravated assault, a class B felony punishable by up to 10 years incarceration and a $20,000 fine.
Wallace was released under a supervised release contract Dec. 8 after posting $500 cash bail, according to personnel at Two Bridges Regional Jail.
