An Alna woman faces a felony assault charge after allegedly throwing a toy at her 4-year-old son, striking him in the face, although the woman said it was an accident.
Cashel P. Fanslau, 33, faces a class C charge of domestic violence assault on a child less than 6 years old. The charge carries a maximum penalty of five years in prison and a $5,000 fine.
Lincoln County Sheriff’s Office Detective Scott Hayden responded to the Fanslau home the afternoon of Friday, Oct. 3. Fanslau’s husband reported the incident.
Hayden spoke with the boy. “He had a fat lip and (a) cut (with) blood on it,” Hayden said in a probable cause statement. “He told me ‘Mom threw Thomas the Train at me.'”
Fanslau and her husband argued after the incident and Fanslau left the residence, according to Hayden.
Fanslau denied the assault. “She admitted to throwing the toy, but said she didn’t mean to hit her son,” Hayden said. Hayden arrested her the evening of Oct. 3.
Fanslau is free on $500 cash bail. Bail conditions prohibit her return to the residence, prohibit the possession or use of dangerous weapons, restrict visitation with the child, and subject Fanslau to random search. She also must report daily by phone and weekly in person to Maine Pretrial Services.
Fanslau is due to appear in Lincoln County Superior Court at 8:30 a.m. Nov. 25.
Fanslau’s attorney, Will Avantaggio, said his client maintains the incident was an accident. He declined further comment.
“I haven’t got discovery yet and I’m not in a position to comment on this,” Avantaggio said.
