Alan Burgess, 64, of Trevett (Boothbay) will serve one year of probation as a result of his guilty plea to a misdemeanor charge of possession of sexually explicit materials.
Justice Jeffrey Hjelm sentenced Burgess to 364 days, all suspended, and one year of probation on Aug. 25 in Lincoln County Superior Court.
The conditions of Burgess’ probation require him to complete treatment as a sex offender and avoid unsupervised contact with non-relatives under the age of 16. He must not access the Internet and is subject to random search to ensure compliance.
He is also subject to sex offender registry requirements for 10 years.
If Burgess violates the conditions, he would face potential incarceration for the remainder of the 364-day sentence.
A Lincoln County Superior Court grand jury indicted Burgess in Feb. 2010 on 10 felony (Class C) counts of possession of sexually explicit materials.
The original charges alleged that Burgess “did… transport, exhibit, purchase or possess” materials depicting a child under the age of 12 “engaging in sexually explicit conduct.”
The office of District Attorney Geoff Rushlau dismissed the original charges as a result of a plea agreement. Burgess instead pleaded to a lesser charge, which contains identical language but refers to children under the age of 16.
Burgess, as a condition of the agreement, has already completed inpatient sex offender treatment.
According to an article in The Lincoln County News at the time of Burgess’ arrest, he taught seventh and eighth grade at Boothbay Middle School for 38 years.
The Maine State Police said there was no evidence any students appeared in the materials.
Sgt. Glenn Lang said Burgess’ computer contained hundreds of videos and still images of child porn.
