A Jefferson man accused of choking, slapping, and throwing a woman across a room last July was sentenced to 364 days in jail with all but four days suspended and two years probation in a plea deal Feb. 3.
Jason Brant Perkins, 30, pleaded guilty in Lincoln County Superior Court to domestic violence assault, class D, and a class B charge of aggravated assault was dismissed.
Perkins received credit against his sentence for four days already served.
Assistant District Attorney Andrew Wright said after the hearing the reason the state agreed to the plea deal was to take into account the wishes of the victim, but also because some issues arose which “clouded the matter,” including the victim’s credibility in the case.
According to the affidavit of Lincoln County Sheriff’s Deputy Ken Hatch, the victim said she and Perkins got into an argument the morning of July 30 about another female being on Perkins’ Facebook page.
After the victim called the third party a name, Perkins allegedly grabbed her “by the face and threw her onto the table and began to choke her and slap her in the face,” the woman said, according to the affidavit.
As the two continued to argue, Perkins allegedly threw the woman across the room into a table and choked her two more times, once for about a minute, according to Hatch’s affidavit.
Hatch wrote he observed marks on the woman’s neck and chin, and there appeared to be a fingerprint on her neck and finger marks on her cheek.
Perkins’ probation conditions include requirements that he complete a certified batterers intervention program and not reside with the victim.
After imposing the jointly agreed-to sentence, Justice Daniel Billings told Perkins the sentence was on the “low end” of what could have been imposed, and cautioned him any violations of his probation such as violent crime or failing to participate in the batterers intervention program would likely send him back to jail.
Perkins’ attorney, Linda Yarmosh, had no comment on the case.
