That the Department of Transportation in accordance with the authority of Title 23 M.R.S.A. Section 651, has determined that public exigency requires the altering, widening, changing the grade, changing the drainage, laying out and establishing of a portion of State Aid Highway No. 1 (Route 129) in the Town of South Bristol, County of Lincoln.
That the Department of Transportation, in accordance with Title 23 M.R.S.A. Sections 701 and 651, has laid out the location of a portion of State Aid Highway No. 1 (Route 129) in the said Town of South Bristol.
That the Department of Transportation, in accordance with Title 23 M.R.S.A. Sections 651 and 151 to 159, has determined that public exigency requires the taking of all land, buildings and rights in land within or adjacent to the boundary lines as herein set forth and described and as shown on a Right-of-Way Map, State Aid Highway No. 1 (Route 129), Town of South Bristol, Federal Aid Project No. BH-1675(000)X, (W.I.N. 016750.00), dated November 2013, on file in the Office of the Department of Transportation, (D.O.T. MAINE WASTE DISCHARGE LICENSE/ MAINE POLLUTANT DISCHARGE ELIMINATION SYSTEM
PERMIT APPLICATION
Please take note that, pursuant to 38 MRSA, Sections 413 and 414-A, SHAW’S FISH & LOBSTER WHARF RESTAURANT, INC. of Rte 32, New Harbor, Maine intends to file a wastewater discharge permit application with the Department of Environmental Protection (DEP). The application is for the discharge of 3,000 gallons of restaurant wastewater to the New Harbor in Bristol, Maine.
The application will be filed on or about February 10, 2014 and will be available for public inspection at DEP’s Augusta office during normal business hours. A copy may also be seen at the municipal offices in Bristol, Maine.
A request for a public hearing or request that the Board of Environmental Protection assume jurisdiction over this application must be received by the DEP, in writing, no later than 20 days after the application is found acceptable for processing, or 30 days from the date of this notice, whichever is longer. Requests shall state the nature of the issue(s) to be raised. Unless otherwise provided by law, a hearing is discretionary and may be held if the Commissioner or the Board finds significant public interest or there is conflicting technical information.
During the time specified above, persons wishing to receive copies of draft permits and supporting documents, when available, may request them from the DEP. Persons receiving a draft permit shall have 30 days in which to submit comments or to request a public hearing on the draft.
Public comment will be accepted until a final administrative action is taken to approve, approve with conditions or deny this application. Written public comments or requests for information may be made to the Division of Water Quality Management, Department of Environmental Protection, State House Station #17, Augusta, Maine 04333-0017.
