The cases of three men, arrested March 12 on charges that they risked serious bodily injury to three Nobleboro residents by firing a weapon at the house they were in, have been tied together for trial.
A docket call for the trial of Sumner C. Keith, 20, of Nobleboro; Chad Clancy Bolster, 19, of Augusta and Anthony J. McCullagh, 19, of Nobleboro will take place in Lincoln County Superior Court, 8:30 a.m., Mon., Oct. 1.
The arrests followed a report of shots fired at a residence at 204 Upper East Pond Rd., around 1:20 a.m. March 12.
According to the Lincoln County Sheriff’s Office, investigators discovered that five rounds struck the house. An adult female and two teenaged males were in the residence at the time of the shooting. No one was injured in the incident.
Deputies subsequently stopped a green 2001 Subaru Legacy, which they believed to be a suspicious vehicle. The Subaru was operated by and registered to Keith, LCSO reported. A .22 caliber rifle was found in the vehicle.
Interviews revealed there was a disagreement between Keith and a male teenager who lived at the address fired upon.
According to the arresting officer’s report, “After interviewing all subjects, it was determined that Chad loaded the gun, Anthony held the wheel to drive and Sumner fired several shots at the Wallace residence.”
Keith is charged with the Class C crime of reckless conduct with a dangerous weapon and criminal operating under the influence.
Bolster faces one count of reckless conduct, a Class C crime.
On July 12 Anthony McCullagh’s attorney, Jeremy Pratt of Camden, filed a motion to suppress “any and all evidence that flowed from a stop of the vehicle Defendant was in.” The motion stated that a search warrant of the vehicle the McCullagh was traveling in, dated March 12, could not be used because of information in the affidavit for the warrant was obtained as a result of the challenged traffic stop.
Prior to that, on July 2, the prosecution filed a motion for revocation of McCullagh’s pre-conviction bail, stating that he was arrested again, three days after his June 27 arraignment on the Class C charge of reckless conduct with a dangerous weapon. The new arrest was for operating under the influence and violating bail conditions.
A status conference on these motions will take place at 8:30 a.m. Thurs., Sept. 27.
