A Newcastle woman and a Nobleboro woman face charges of oxycodone possession after their arrest at Mr. Mike’s in Damariscotta near midnight Monday, Jan. 26.
Nichole L. Brackett, 29, of Newcastle, faces charges of unlawful possession of a scheduled drug, a class C felony; and violation of condition of release, a class E misdemeanor.
Courtney J. Flint, 21, of Nobleboro, faces the same possession charge. She was also arrested for failure to pay fines from a previous conviction for oxycodone possession and for a probation hold.
Damariscotta Police Department Sgt. Jason Warlick said he saw Brackett in the driver’s seat of a Jeep in the parking lot of Mr. Mike’s.
Brackett’s driver’s license is suspended, Warlick said. She is subject to bail conditions, including random search.
Warlick searched Brackett and found three 5-milligram oxycodone pills, a piece of an unknown pill, a used hypodermic needle, and a mirror with a white powder on it “indicative of prescription drug abuse,” he said.
Brackett did not have a prescription for the oxycodone, Warlick said. He arrested her and transported her to Two Bridges Regional Jail in Wiscasset.
She posted $500 cash bail and was released Wednesday, Jan. 28, according to jail personnel.
Her bail conditions prohibit the possession or use of alcohol or illegal drugs, require “intensive outpatient therapy,” and subject her to random search and test, according to court documents.
Lincoln County Sheriff’s Deputy Jared Mitkus arrested Flint, a passenger in the vehicle. Flint also had a hypodermic needle and tested positive for multiple illegal drugs at the jail, Lincoln County Sheriff’s Office Lt. Rand Maker said.
Flint remains at the jail on a probation hold with no bail.
For Brackett, the arrest was the second in four months and third in 6 1/2 months.
Brackett was arrested July 16, 2014 on a charge of aggravated trafficking in scheduled drugs, a class A felony. A Lincoln County grand jury, however, did not return an indictment in the case.
Brackett was arrested again Sept. 26, 2014 for allegedly burglarizing a car that afternoon in the area of Elm Street in Damariscotta.
She faces charges of motor vehicle burglary, a class D misdemeanor; and theft by unauthorized taking, a class E misdemeanor, in connection with the September arrest.
She pleaded not guilty to the burglary and theft charges Oct. 29, 2014. She is due to appear in 6th District Court in Wiscasset at 10:30 a.m., Thursday, Feb. 5.
Brackett was convicted of drug-related charges in 2005 and 2012, according to court documents.
Brackett did not immediately respond to a request for comment.
