A Washington man police allege struck and killed his friend with a vehicle in Waldoboro last November was indicted by grand jury March 11 on one count of criminal operating under the influence, a class B felony.
Jeffrey R. Moran, 28, was operating a 1999 GMC Yukon on Feyler’s Corner Road in Waldoboro when he allegedly struck his friend Jessie Hayden, who was riding a bicycle on the roadway, according to a press release from the Waldoboro Police Department.
Hayden was pronounced dead at the scene, according to the release.
Hayden lived a short distance up the road and Moran was headed to pick him up at the time of the accident, according to police.
Moran originally reported he had found a bike in the roadway and then saw a male in the ditch, but later allegedly said Hayden was in the road on a bicycle when he hit him, according to police documentation.
Hayden was not wearing reflective gear nor a helmet at the time, Waldoboro Police Chief Bill Labombarde said at the time.
Waldoboro Police Officer Thomas Bartunek administered a field sobriety test to Moran, and a later breath test showed Moran had a breath alcohol content of 0.09 percent, according to Bartunek’s affidavit.
Moran was arrested and later released on $10,000 bail.
Moran is due to be arraigned on the aggravated criminal OUI charge in Lincoln County Superior Court on March 27 at 8:30 a.m.
If convicted, Moran could face up to 10 years in prison and a $20,000 fine, according to the Maine Criminal Code.
A call to Moran’s attorney, Philip Cohen, was not returned by press time.
