Notice is hereby given that in accordance with the Judgment of Foreclosure and Sale entered April 2, 2019 in the action entitled Marilyn Tibbetts as assignee from Camden National Bank Successor by Acquisition of the Bank of Maine, F/K/A Savings Bank of Maine, F/K/A Gardiner Savings Institution FSB v. Michael R. Tibbetts and Alyssa Tibbetts, in her capacity as Personal Representative of the Estate of Mark C. Tibbetts, by the Lincoln County Superior Court, Docket No. RE-17-09, wherein the Court adjudged the foreclosure of a mortgage granted by Mark C. Tibbetts to Camden National Bank, Successor by Acquisition of the Bank of Maine, F/K/A Savings Bank of Maine, F/K/A Gardiner Savings Institution FSB, dated November 9, 2001 and recorded in the Lincoln County Registry of Deeds in Book 2776, Page 281, and Assignment dated June 20, 2018 and recorded in the Lincoln County Registry of Deeds in Book 5278, Page 106, the period of redemption having expired, a public sale of the property described in the mortgage will be conducted on Monday, November 25, 2019, commencing at 10:00 AM at the Law Office of Peter L. Hatem, P.C., 258 US Route One, Scarborough, Maine 04074. The foreclosure sale will be for a one-half remainder interest in the property as described in, and in accordance with, the Judgement of Foreclosure and Sale.
The property is located at 12 Old Ice House Road, Boothbay Harbor, Maine.
The sale will be by public auction. All bidders for the property will be required to make a deposit of $5,000.00 by certified check or bank check at the time of the public sale made payable to “Attorney Peter L. Hatem Client Trust Account”, which deposit is non-refundable as to the highest bidder. The balance of the purchase price shall be paid within thirty (30) days of the public sale. In the event a representative of the mortgagee is not present at the time and place stated in this notice, no sale shall be deemed to have occurred and all rights to reschedule a subsequent sale are reserved.
