The STATE OF MAINE, acting by and through its Department of Transportation, (the “Department”) does hereby give notice to all whom it may concern:
That the Department, in accordance with the authority of Title 23 M.R.S. Sections 651 and 151-159, has determined that public exigency requires the taking of certain land, buildings and rights in land located in the Town of Wiscasset, Lincoln County, Maine as herein set forth and described and as shown on a Right of Way Map for State Project No. 21843.00 Part I, WIN 021843.00, State Highway “26” (U.S. Route 1), Wiscasset, Lincoln County, dated March 2017 and on file in the Office of the Department of Transportation, D.O.T. File No. 8-183, to be recorded in the Registry of Deeds of Lincoln County, a print of which is on file in the office of the County Commissioners of Lincoln County.
DESCRIPTION OF FEE TAKING
All land, buildings, improvements, and rights in land not otherwise excluded herein, and located within the following described boundaries owned or held by Coastal Enterprises, Inc., its successors and assigns are hereby acquired in fee simple:
A CERTAIN LOT OR PARCEL OF LAND with buildings thereon located on the westerly side of Water Street in the Town of Wiscasset, Lincoln County, Maine as shown on said Right of Way Map as Parcel No. 1, bounded and described as follows:
BEGINNING at a pin located on the westerly side of Water Street in said Wiscasset at the northeasterly corner of the property hereby acquired;
“THENCE S 33° 31’ W 175.83 feet along the westerly side line of Water Street to a pin;
THENCE N 56° 29’ W 89 feet to a pin;
THENCE N 33° 31’ E 6.42 feet to a pin;
THENCE N 54° 29’ W 17.27 feet to a pin;
THENCE N 35° 20’ E 59.87 feet to a pin;
THENCE S 56° 00’ E 7.45 feet to a pin;
THENCE N 39° 00’ E 55 feet to a pipe;
THENCE N 56° 00’ W 2.5 feet to a pin;
THENCE N 39º 00’ E 54.5 feet to a pipe;
THENCE S 56° 29’ E 94 feet to the point of beginning.”
Meaning and intending to describe the first parcel conveyed in a deed from Maine Savings Bank to Coastal Enterprises, Inc. dated September 28, 1990 and recorded in Book 1649, Page 45 of said Registry of Deeds.
Further meaning and intending to acquire and extinguish any and all rights of Coastal Enterprises, Inc., in and to a right of way across premises lying southerly of and adjacent to the before described parcel as referenced in a deed from F. Burton Haggett to Alexander M. Weatherby dated May 26, 1928 and recorded in Book 383, Page 374 of said Registry of Deeds; said right of way being further referenced in the before mentioned Maine Savings Bank deed recorded in Book 1649, Page 45 of said Registry of Deeds and as further depicted on said Right-of-Way Map.
EXCEPTIONS AND RESERVATIONS
Excepted and reserved from the before described acquisition in fee simple are all existing easements and/or rights of way of record, however acquired, and located within the afore described boundaries.

The Department of Transportation directs that this Notice of Condemnation be recorded in the Registry of Deeds of Lincoln County, filed with the Town Clerk of the Town of Wiscasset and the County Commissioners of Lincoln County, and published in the “Lincoln County News,” a newspaper of general circulation in the County where the within described property is located; the Department further directs that a copy of the Right-of-Way Map be filed with the County Commissioners of said county, and also that a notice be sent, by certified mail, to any persons noted herein as apparent owners of record or parties in interest, as well as mortgagees of record, in all cases in which addresses for such persons are reasonably ascertainable.
