Two men, arrested March 12 on charges that they risked serious bodily injury to three Nobleboro residents by firing a weapon at the house they were in, have reached a plea agreement with prosecutors.
Sumner C. Keith, 20, of Nobleboro and Anthony J. McCullagh, 19, of Nobleboro were arrested, along with Chad Clancy Bolster, 19, of Augusta, following a report of shots fired at a residence in Nobleboro, March 12 at around 1:20 a.m.
Keith pleaded guilty, Oct. 3, to the Class C crime of reckless conduct with a dangerous weapon and Class D criminal operating under the influence.
On the first count, Keith was sentenced to 2.5 years in jail, with all but six months of that sentence suspended. The sentence was stayed until Fri., Oct. 19.
Keith will remain on probation for two years following the completion of his sentence and must pay $25 to the victim compensation fund. All three of the men must jointly pay $250 in restitution to benefit a victim of their crime.
On the second count, Keith is required to pay a fine of $500 and will have his license to operate a motor vehicle suspended for 90 days, beginning Oct. 3.
He may not possess or use illegal drugs or alcohol and must pay the Dept. of Corrections a supervision fee of $10 per month during the probation period. Keith is prohibited from owning, possessing or using firearms and must submit to random testing for alcohol, drugs, firearms and other dangerous weapons.
The three men are prohibited from contact with one another.
McCullagh pleaded guilty, Aug. 9 to the Class D charge of reckless conduct with a dangerous weapon. The plea was entered by the court Aug. 30 and McCullagh was sentenced to serve 364 days with all but 30 days suspended.
He will serve one year of probation, during which he must submit to random testing for alcohol, drugs, firearms and other dangerous weapons and refrain from contact with the victims of the crime. McCullagh must also submit to an evaluation and counseling for substance abuse issues.
According to the Lincoln County Sheriff’s Office, investigators discovered that five rounds struck the house at 204 Upper East Pond Rd., where an adult female and two teenaged males were in the residence at the time of the shooting. No one was injured in the incident.
Deputies subsequently stopped a green 2001 Subaru Legacy, which they believed to be a suspicious vehicle. The Subaru was operated by and registered to Keith, LCSO reported. A .22 caliber rifle was found in the vehicle.
Interviews revealed there was a disagreement between Keith and a male teenager who lived at the address fired upon.
According to the arresting officer’s report, “After interviewing all subjects, it was determined that Chad loaded the gun, Anthony held the wheel to drive and Sumner fired several shots at the Wallace residence.”
Bolster pleaded guilty, Oct. 1, to the misdemeanor charge of reckless conduct. Justice Andrew Horton sentenced him to 364 days in jail with all but 21 days suspended and one year of probation.
