The Lincoln County Superior Court unsealed the indictment of Franklin Poe on Jan. 20.
According to the indictment, Poe, a former attorney from Boothbay, has been charged with theft in excess of $10,000, the highest level of theft in Maine law, and the misuse of property entrusted to him.
The property entrusted to him, and the money he allegedly stole, belonged to the Josephine Davis Day Revocable Trust.
Poe is currently in jail in Salt Lake City, Utah, and has agreed to return to Maine voluntarily, according to Assistant Attorney General Leanne Robbin. The state hopes to have Poe brought back by Jan. 25, Robbin said.
Poe was indicted earlier this year, but the indictment was not made public until his return to Maine could be arranged, Robbin said.
